Terms and Conditions of Sale

1. Scope

These Terms and Conditions of Sale apply to any order for the creation of a website placed through the Tech Minds online configurator, whether the customer is a business or a consumer.

Placing an order implies full and unconditional acceptance of the Terms and Conditions of Sale in force at the time of confirmation.

2. Description of the services

Tech Minds offers websites based on optimised templates, which can be customised through a configurator. Each offer specifies the features included, the scope of possible customisation, the indicative delivery time and the corresponding price.

3. Prices, deposit and payment of the balance

Prices are expressed in euros, including all applicable taxes, unless otherwise stated. The customer pays a deposit when placing the order and then pays the remaining balance upon delivery of the website, via the secure payment link available in the client dashboard.

The order is considered firm only after the deposit has been received. Work on the website design and customisation begins once the deposit payment has been successfully processed.

4. Promo codes and sales commissions

When a customer uses a promo code linked to a business finder, the customer receives a discount as displayed in the configurator. Tech Minds pays the main business finder a commission calculated on the total amount of the order, once the customer has fully paid the balance.

When a business finder sponsors another business finder, Tech Minds may also pay the sponsor an additional commission calculated on a net amount, after deduction of applicable charges. The technical details of this calculation are explained in the sales dashboard and may be updated in the future. If the Stripe account is not valid or not verified, the commission cannot be paid.

5. Right of withdrawal and refund policy

In accordance with French consumer law, a 14-day withdrawal period may apply to service contracts when the client is a consumer.

However, the client is informed that the payment of the deposit constitutes explicit consent to begin the execution of the service immediately, in accordance with Article L221-25 of the French Consumer Code.

As a result, once the deposit is paid and the work has begun, the client waives their right of withdrawal and no refund of the deposit can be issued.

Furthermore, no refund is possible once the remaining balance has been paid, as the service is considered delivered or in the process of personalized execution.

6. Customer obligations

The customer agrees to provide Tech Minds with all information necessary for the proper creation of the website (content, texts, images, possible access details) within reasonable timeframes. Delays or failures to validate key steps may result in adjustments to the delivery schedule.

7. Liability and governing law

Tech Minds will use reasonable efforts to deliver a website that matches the description validated in the configurator. Tech Minds cannot be held liable for any improper use of the website by the customer or for consequential or indirect damages.
